Personal injuries claims in the Caribbean most often arise out of road accidents and workplace incidents. In many cases, liability is not contested and the sole issue is the amount of compensation payable to the injured. The amount of compensation to be paid in an individual case is often settled out of court by the respective attorneys and, in order to reach agreement on the quantum, attorneys commonly refer to records of the amounts paid in previous, similar cases, according to the nature of the injuries suffered. In addition, in a case of serious and permanent injury, where the claimant’s future employment prospects have been adversely affected by the injury, agreement will need to be reached on compensation for future loss of earnings.
